LAWS: 1. Has no sodomy laws, the age of sexual consent is 18 for males, and between 14 and
18 for females, depending on their sexual maturity. Sexual activity with a person
under 18 is punished with prison term of up to 8 years.
2. In the Army, untraditional relationship between men are considered contrary to military
requirements and laws, and are severely prosecuted.
NOTE: 1. Gay life in Belarus is still largely underground, and most Belarussians
consider homosexuality a disease. The country's only gay club, Oscar, was closed by
the government in February 2000 because police said it "gathers abnormal
people," although some mainstream clubs reportedly hold specific gay nights.

I. Ages for legal purposes
Age of simple majority
Irrespective of sex, the legal age of majority is eighteen (18) years .
Age of consent for sexual activity
The legal age of consent for sexual activity is the legal age of majority, eighteen (18)
years.

Age of consent for marriage
The legal age of consent for marriage is the legal age of majority, eighteen (18) years.
Sexual intercourse (including anal and oral intercourse) with a child, involving the use
of violence
(including threats or surprise) is covered by Article 115 entitled " Rape " and
Article 199 entitled
" Buggery ", of the Byelorussian Penal Code.
Sexual intercourse with a child committed without the use of violence is the subject of
Article 117 of
the Byelorussian Penal Code.
II. Rape
Article 115 of the B Byelorussian Penal Code states
" Rape, which is the sexual intercourse committed with the use of violence, threat or
making
benefit of the helpless or powerless condition of the victim, involves 3 to 7 years of
imprisonment.
Rape committed by a person who had committed the same offence in the past, involves 5 to
10
years of imprisonment.
The same criminal action committed by a group of persons or committed against a minor (a
victim
, i.e. girl, aged over fourteen (14) but below eighteen (18)) involves 5 to 15 years of
imprisonment.
Rape committed by the extremely dangerous recidivist or which has led to extremely grave
consequences for the victim as well as rape committed against a child (a girl aged below
fourteen
(14)) involves 8 to 15 years of imprisonment or death penalty. "
III. Other forms of child sex abuse
Involving the use of violence, Article 119 of the Byelorussian Penal Code, entitled
‘Buggery’, states
" A buggery committed with the use of the physical violence, threats or against a
minor as well as
by making benefit of the authority over the victim, involves up to 8 years of
imprisonment. "
Without the use of violence, Article 117 of the Byelorussian Penal Code, entitled
‘Sexual intercourse with a
person aged below sixteen (16)’, states
" Sexual intercourse with a person aged below sixteen (16), provided that the
offender was aware of
the victim’s age, involves up to 3 years of imprisonment.
The same actions committed in perverted forms, involve up to 6 years of
imprisonment. "
Please note that there are no legislative provisions governing sexual intercourse with a
child
committed by persons related to the victim or having authority over the child.
The other forms of sexual abuse of children (excluding rape), are covered by Article 118
of the
Byelorussian Penal Code, entitled " Depraved actions ", which states :
" Depraved actions committed against a person aged below sixteen (16), provided that
the
offender was aware of the victim’s age, involve up to 3 years of imprisonment. "
IV. Child prostitution and child pornography
The existing Byelorussian legislation does not contain such terms as " Child
Prostitution " or " Child Pornography ".
Up to now, no information has been received in connection wiht the offences of
prostitution or pornography in general.
